The family of a 44-year-old Kansas City man injured in October 2023 after being hit by a car while crossing a downtown street has settled a claim with the responsible driver’s insurer for $1.25 million.
Willie Spencer was attempting to cross Broadway Boulevard at its intersection with West 37th Street on Oct. 24, 2023, shortly after 8:30 p.m., when he was struck by a 2018 Mazda CX5 driven by Madison Bauers, 18, of Green River, Wyoming, a police accident report shows.
Plaintiff’s attorney Nick Hilyard said the teen driver was “traveling at a high rate of speed despite her obstructed vision (on a rainy night), which the responding law enforcement officer concluded was a probable contributing circumstance,”
Hilyard added that EMS noted in its records that bystanders on the scene also advised that the Mazda was going “pretty fast,” enough to throw Spencer into the air.
Spencer’s injuries included contusions of both lungs; an open skull fracture; a frontal bone fracture; broken teeth; fractures of his first, second and sixth cervical vertebrae; an injury to his cervical spine ligament; and abrasions to his head, face, hands, left second and fourth fingers and right second and fourth fingers. His subsequent death was unrelated to his injuries from the crash.
Records provided by Hillyard show that the claim was settled out of court on Oct. 1.
