Plaintiff obtains six-figure settlement after tool chest falls and causes injury

A mechanic obtained a six-figure settlement after he was injured by the defendant’s unsecured tool chest.

The defendant was hired to pick the tool chest up from the plaintiff’s home and deliver it to his employer. However, the defendant failed to adequately secure the tool chest causing it to fall on the plaintiff. This caused multiple injuries to the plaintiff’s dominant hand, shoulder and right knee, according to his attorney Laurie Del Percio of the Horn Law Firm.

Immediately after the accident, the plaintiff went to the emergency room and later followed up with his primary care doctor where he was diagnosed with a crushing injury to his right hand.

The case was settled for $105,000 before trial. Del Percio told Missouri Lawyers Media the fact that his dominant hand was injured played a vital role in securing the settlement.

“Since he is a mechanic — that’s why he was moving the tool chest — and since it’s his dominant hand that has created more complications for him and prolonged recovery,” she said.

Additionally, Ring Doorbell footage captured the incident and was essential in establishing the defendant’s liability, Del Percio said.
